Terms & Conditions

About Us

These Terms & Conditions apply to purchases made from Everest Custom through everestcustom.co.uk.

Everest Custom supplies personalised and custom printed products including stickers and labels, domed gel inserts, badges, keyrings, medals, school products, trophy and medal inserts, and related items.

By placing an order with us, you agree to these Terms & Conditions.

Products

We take reasonable care to ensure that product descriptions, specifications, images and dimensions are accurate.

Please note:

  • Product images are illustrative and screen colours may differ slightly from printed colours.
  • Minor manufacturing, cutting and sizing tolerances may occur.
  • Personalised products may vary slightly between production batches.
  • Product specifications may be updated where reasonably necessary.

Nothing in these Terms affects your statutory consumer rights.

Personalised & Custom-Made Products

Many Everest Custom products are made specifically to your requirements, including products featuring your:

  • Logo
  • Artwork
  • Text
  • Colours
  • Shape
  • Size
  • Personalisation

These products are normally treated as personalised or made-to-specification goods.

This is important because different cancellation rights apply to personalised products. Under the Consumer Contracts Regulations, the normal distance-selling cancellation right does not apply to goods made to a consumer’s specifications or clearly personalised.

Orders

When you place an order, you are responsible for ensuring that:

  • Your contact and delivery information is correct.
  • The product, size, quantity and personalisation details are correct.
  • Any artwork supplied is suitable for your intended product.

An automated order acknowledgement confirms that we have received your order. We may contact you if additional information, artwork or approval is required before production.

We may refuse or cancel an order where, for example:

  • A product is unavailable.
  • There is an obvious pricing or website error.
  • Payment cannot be authorised.
  • We cannot produce the requested item.
  • Submitted artwork may infringe intellectual property rights or applicable law.
  • Fraud or misuse is reasonably suspected.

If we cancel an order after receiving payment, we will refund the appropriate amount.

Artwork

You are responsible for checking the accuracy and suitability of artwork supplied to us.

By submitting artwork, you confirm that:

  • You own it or have permission to use it.
  • Its use does not infringe another person’s copyright, trademark or other rights.
  • The artwork does not contain unlawful material.

We reserve the right to refuse artwork that we reasonably believe is unlawful or infringes third-party rights.

Customers retain ownership of artwork they provide. You grant Everest Custom permission to use that artwork only as reasonably necessary to quote for, produce, supply and support your order.

Artwork Proofs

Where we provide a digital proof, please check it carefully before approval, including:

  • Spelling
  • Names
  • Numbers
  • Colours
  • Layout
  • Logos
  • Sizes
  • Product details

Production may begin once a proof is approved.

We cannot normally accept responsibility for errors that were visible on a proof and approved by the customer, although this does not affect any rights you have where the finished goods do not match the approved proof or are otherwise faulty.

Pricing & Payment

Prices are shown in pounds sterling.

Any applicable taxes, delivery charges or other mandatory costs will be shown before you complete your order.

Payment must be made using one of the payment methods available at checkout.

Production may not begin until:

  • Payment has been received.
  • Required artwork has been supplied.
  • Any necessary proof has been approved.

Production & Delivery

Production times vary depending on the product, quantity, artwork and level of customisation.

Any production or delivery times shown are estimates unless we expressly agree a guaranteed date.

We aim to dispatch orders as promptly as possible, but delays may occasionally occur because of circumstances outside our reasonable control.

For consumer orders, goods must generally be delivered within 30 days unless a different delivery period has been agreed.

Please make sure the delivery address supplied with your order is accurate.

Changes & Cancellations

If you need to change or cancel an order, contact us as soon as possible at:

info@everestcustom.co.uk

If production has not started, we will try to accommodate reasonable changes or cancellation requests.

However, once work has begun on a personalised or custom-made product, cancellation may not be possible.

For non-personalised goods bought online, consumers normally have a 14-day right to cancel after receiving the goods. Personalised and custom-made goods are generally exempt from this change-of-mind right.

Returns, Faulty Goods & Refunds

Personalised or custom-made goods cannot normally be returned simply because you change your mind.

However, this does not affect your statutory rights.

If an item is:

  • Faulty
  • Damaged
  • Not as described
  • Incorrectly produced compared with the agreed specification

please contact us as soon as possible with your order number and, where appropriate, photographs of the issue.

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund under applicable consumer law. Businesses cannot contract out of responsibility for faulty or misdescribed consumer goods.

Please also see our Return & Refund Policy.

Customer Responsibilities

You are responsible for:

  • Providing accurate order information.
  • Supplying suitable artwork.
  • Checking proofs where provided.
  • Ensuring you have permission to use submitted artwork.
  • Checking delivery details.
  • Informing us promptly if there is a problem with your order.

Intellectual Property

Unless otherwise stated, website content created or owned by Everest Custom, including branding, graphics, text and product photography, is protected by intellectual property rights.

You may not reproduce or commercially use our website content without permission.

This does not affect ownership of artwork that customers submit to us.

Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or restricted, including your statutory consumer rights.

We are not responsible for losses caused solely by inaccurate information or artwork supplied by the customer.

For business customers, to the extent permitted by law, we are not liable for indirect or consequential business losses such as loss of profit, revenue or opportunity.

Consumer contracts cannot use unfair terms to remove responsibility for matters such as faulty goods or goods that are not as described.

Events Outside Our Control

We are not responsible for delays caused by events outside our reasonable control, such as:

  • Severe weather
  • Courier disruption
  • Industrial action
  • Supply shortages
  • Power or internet outages
  • Government restrictions
  • Other unforeseen disruptions

If a significant delay occurs, we will take reasonable steps to keep affected customers informed.

Privacy

We process personal information in accordance with our Privacy & Cookie Policy.

Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, this does not remove any mandatory legal protections or rights that apply where you live.

Changes to These Terms

We may update these Terms & Conditions from time to time.

The version in force when you place your order will normally apply to that order.
